LEGAL RESPONSIBILITY OF EGOA

Thank you for visiting EGOA’s website (www.egoa.app) (“the Site”), contacting EGOA, and/or using any of EGOA’s mobile applications or services (the “Services”). This Privacy Policy is intended to describe how EGOA handles information that you provide to or that we learn about individuals who: visit our website, contact us by mail, email, or phone or in person, or provide us with information by any other means. We recommend that you carefully review this notice before providing any information to us. By accessing and using the Services, you agree to this Privacy Policy and our Terms of Use.

By visiting or using the Services, you expressly consent to the processing of your personal information in accordance with this Privacy Policy. If you do not agree with our policies and practices, your choice is not to use the Services. Your personal information may be processed in the country where it was collected as well as in other countries (including the United States) where laws regarding the processing of personal information may be less stringent than the laws in your country. By uploading personal information to the Services, you warrant that you have the right to transfer such information outside of your country.

GENERAL SPECIFICATIONS

Children's Privacy

The EGOA website and Services are not intended for children under 18 years of age, and EGOA does not knowingly collect any information from children under 18 years of age through its website. If a parent or guardian of a child under 18 years of age believes that the child has provided us with information, the parent or guardian must contact us if they wish for this information to be removed from our records. If EGOA becomes aware from any source that it has information about a child under 18 years of age in retrievable form in its records, we will remove that information from our existing records.

What Information Does EGOA Collect and How is it Used?

Registration Information

When you register to create an account, subscribe to a newsletter, or contact us with a question or comment, you may voluntarily provide us with certain information, such as your name, email address, phone number, or other contact information. We will use this information to manage your account and respond to or fulfill any requests or inquiries you make.

Purchase Information

If you request to purchase a home using the Services, you will be required to provide certain information that EGOA will use to verify your identity and complete and manage the sale. This may include: legal name, date of birth, address, a copy of your government-issued ID, passport, national ID card, or driver's license. We may also collect information about your bank account, credit history, or other necessary information to manage your account. Your home purchase request will contain full information on how we may use and access your online banking information. With your express authorization, we may use your information to conduct a credit check or otherwise assess your eligibility to receive a loan or other financing.

Financing Information

At this time, EGOA provides a link to Altera Finance, a third-party loan provider, for users to request and receive a mortgage or other financing options. EGOA provides this link for your convenience. Any information you provide to Altera Finance is subject to Altera Finance’s privacy policy and terms of use. We recommend reviewing these policies before providing any information to Altera Finance. If EGOA offers financing directly or otherwise partners with or links to a different third-party provider, EGOA will update this policy.

Public Posting

You may also choose to post or upload additional information, such as videos, photos, or other content (“User Content”) to publicly available portions of the Services. User Content that you post in a public forum or that is otherwise publicly available will be accessible to other users of the Website and may be retrievable by third-party search engines. Third parties may also download or share your User Content on social media sites like Facebook, Pinterest, Twitter, Google+, and via email. We recommend protecting your privacy and anonymity and not uploading any User Content you are not comfortable having publicly available. Any third party with access to your information via the Services will have permission to use the information in the same way as if you had sent it directly to that third party. Posting any information on the Website is completely voluntary, and we recommend that you carefully consider the information you choose to make publicly available.

Non-Personal Information

Like most website operators, EGOA collects non-personally identifiable information of the type that web browsers and servers typically make available, such as browser type, language preference, referring site, and the date and time of each visitor request when visitors use the Services. EGOA’s purpose in collecting non-personally identifiable information is to better understand how visitors use the Services. From time to time, EGOA may release non-personally identifiable information in aggregate form, for example, by publishing a report on trends in the use of its Services, and EGOA may use aggregated information for any purpose without obligation. EGOA may also collect potentially personally identifiable information, such as Internet Protocol (IP) addresses, and may collect statistics on visitor behavior to the Services. For example, EGOA may monitor the Services to help identify spam. We may also use these technologies to collect information about your activities online over time and across third-party websites or other online services (behavioral tracking).

In addition to registration data, we may collect information about the device you are using to access the Services, including device type, operating system, device settings, device identifiers, and lock data. Whether we collect part or all of this information often depends on the type of device you are using and your settings. For more information on the information your device makes available to us, review the policies of your device manufacturer or software provider.

We do not automatically collect personal information, but we may link this information to personal information about you that we collect from other sources or that you provide.

Additionally, we may use third-party services such as Google Analytics, which collect, monitor, and analyze this type of information in order to enhance the functionality of the Services. These third-party service providers have their own privacy policies addressing how they use such information.

How We Use Your Information

We use the information we collect to provide you with full access and functionality of the Services. As a result, your information may be used for the following purposes:

(xi) to evaluate general interest in the Services;

(xii) to resolve disputes between any of our members and enforce our agreements with third parties;

(xiii) to enforce our Terms of Service and other policies and comply with our legal obligations; and

(xiv) for any other purpose with your consent.

In relation to the above activities, we may perform profiling based on your interactions with the EGOA Services, your profile information, and other content you submit to the EGOA Services, and information obtained from third parties.

We process this personal information for these purposes based on our legitimate interest in protecting the EGOA Services, measuring the proper performance of our contract with you, and complying with applicable laws.

Who Do We Share Your Information With?

Personal Information

EGOA may share Personal Information with certain third parties such as our agents, service providers, and other representatives who act on our behalf. For example, we may share Personal Information with third parties to perform services on our behalf, such as: managing properties; obtaining and maintaining insurance coverage; processing payments or fees; and performing other business activities as necessary. Third parties with whom we do business are authorized to use your information only to perform the service they are contracted to provide. They are required to comply with the terms of our Privacy Policy, including reasonable measures to ensure your personal information is secure. We occasionally contract with trusted third-party providers who would receive your Personal Information and perform aggregated, anonymous analysis of the data. Through our contractual arrangements, we require our contractual partners to maintain adequate security for the Personal Information provided to them. We do not permit such third parties to sell your Personal Information to other parties.

Other Ways We May Share Your Personal Information

We may disclose non-personally identifiable aggregate information about our users without restriction.

Aside from to our employees, contractors, and affiliated organizations, or as described above, we disclose personally identifiable information only when required by law, or when we believe in good faith that the disclosure is reasonably necessary to protect the property or rights of EGOA, third parties, or the public at large. If you send us a request (e.g., via chat, a support email, or through one of our feedback mechanisms), we reserve the right to post it to help clarify or respond to your request or to assist us in supporting other users.

Additionally, in some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets transferred. Furthermore, if EGOA or substantially all of its assets were acquired, or in the unlikely event that EGOA goes out of business or enters bankruptcy, user information would be one of the assets transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of EGOA may continue to use your personal and non-personal information as set forth in this policy. Otherwise, we will not rent or sell personally identifiable and potentially personally identifiable information to anyone.

We may also disclose your personally identifiable information if you give your express consent to the disclosure.

Security

We are committed to protecting your Personal Information. We perform regular testing on our facilities and use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure.

We Do Not Sell Your Personal Information

EGOA does not sell or rent the personal information we have collected or retained about you to any other third parties for profit. Therefore, we do not offer people the ability to “opt-out” of the sale or rental of personal information because we do not engage in such practices.

Our Data Retention Criteria

The length of time we retain your personal information varies depending on the purpose of the processing. For example, we retain personal information necessary to provide you with products and services or to facilitate transactions you have requested for as long as you are a customer of EGOA. We retain your personal information for marketing purposes until you opt-out of receiving further direct marketing communications, as required by applicable law. In all other cases, we retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Statement, after which it will be anonymized (where permitted by applicable law), deleted, or destroyed.

Our Use of Cookies and Analytical Tools

Cookies are text files containing small amounts of information that are downloaded to your hard drive or browser memory when you visit one of our Sites. Cookies are useful because they help organize content and design on our Sites and enable them to remember you when you return. For instance, cookies can help us remember your preferences on our Sites. Most browsers accept cookies automatically, but you can configure your browser settings to block or reject cookies.

We also use third-party analytical tools, including Google Analytics, to analyze traffic on our sites and apps. These third-party providers use cookies to gather information.

Your Rights and Responsibilities

You have the right to provide personal information to EGOA only if that information is accurate, reliable, and relevant to our relationship, and only to the extent that such disclosure does not violate any applicable data protection law, statute, or regulation.

You may have certain rights under applicable data protection law with respect to the personal information we collect through the Sites or when you communicate or interact with us in other ways. To exercise any of these data privacy rights, please contact us, or have your authorized agent contact us as described in the "Contact Us" section below. In the event that you submit, or your authorized agent submits on your behalf, a data request, you (and your agent) hereby acknowledge and agree, under penalty of perjury, that you are (or your agent is) the consumer whose personal information is the subject of the request. We will respond to any data request within the timeframes required by law, and we may charge a fee to facilitate your request when permitted by law.

Marketing

You have the right to opt-out of receiving electronic direct marketing communications from us. All electronic direct marketing communications you receive from us, such as emails, will give you the option to opt-out of receiving further communications from us.

California Privacy Rights. The California Civil Code allows users of the Sites who are residents of California to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Under the California Consumer Privacy Act of 2018, as amended ("CCPA"), California residents may have certain data privacy rights, such as the right to be notified about the categories of personal information that are collected about you and our intended use and purpose for collecting your personal information. You have the right to request access to your personal information and, to the extent possible, request that it be transmitted in certain forms and formats. You may have the right to request that we (and any applicable service providers) delete your personal information. You have the right not to be discriminated against for exercising your rights under the CCPA. If you make, or an authorized agent on your behalf makes, any request related to your personal information, EGOA will verify your identity to the degree of certainty required under the CCPA before addressing your request. EGOA may require you to match at least three pieces of personal information that we have previously collected from you before granting access or otherwise responding to your request.

Do Not Track. Some web browsers may transmit "Do Not Track" signals to the Sites that the user interacts with. Due to differences in how web browsers implement and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or if they are even aware of them. We do not currently take action in response to these signals.

European Union (EU) Privacy Disclaimer

EGOA processes personal information in accordance with the legal bases set forth in the EU General Data Protection Regulation (GDPR) or the law of EU member states. For example, our processing of personal data about individuals (as described above) is justified based on legal provisions that (1) the processing is based on consent; (2) the processing is necessary for the legitimate interests of EGOA as stated here; and (3) the processing is necessary for the performance of a contract to which you are a party. If you are in the EU or are protected under the GDPR, you may have certain rights regarding your personal data. To the extent permitted by applicable data protection laws, you may access the personal data we hold about you; request that inaccurate, outdated, or no longer necessary information be corrected, deleted, or restricted; and request that we provide your personal data in a format that allows you to transfer it to another service provider. You may also withdraw your consent at any time when we rely on your consent for the processing of your personal data. You may object to our processing of your personal data when such processing is based on our legitimate interest. You have the right to file a complaint with your competent data protection authority. If you wish to exercise any of these rights, please contact us in accordance with the instructions provided below.

The Services may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly encourage you to review the Privacy Policy of every site you visit. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

Changes to this Privacy Policy

We may occasionally update this Privacy Statement. When we do, we will revise the "last updated" date at the top of the Privacy Statement and take any additional actions that may be required by law.
